The contention of the appellant is that the matter was listed for 18.8.14 which was a Gazetted Holiday on account of ‘Janamashatmi’.  It was on the next date i.e. 19.8.14 when he was proceeded against ex-parte.  Obviously the appellant/OP did not have the knowledge that the matters listed for 18.8.14 were to be taken up on 19.8.14.  In the circumstances appeal is allowed. Orders dated 19.8.2014 proceeding against the appellant ex-parte, are set aside. Appellant/OP to appear in the Ld. District Forum on date already fixed 18.11.2014 and file his written version. Ld. District Forum to take the same on record and proceed with the matter in accordance with law. 

A copy of this order be sent to the District Forum for compliance.
