                   This application has been filed by the revision petitioner for staying the proceedings of complaint No.753/2019 before District Forum-I, UT, Chandigarh for 02.12.2019 till the decision of present revision.

                   The learned Counsel for the revision petitioner wants to withdraw the previous affidavit, which was got attested on 28.11.2019 and in its place, he wants to place on record new affidavit. His request is allowed. The said affidavit is taken on record.

                Office is directed to put the new affidavit at the appropriate place.

                This revision petition has been filed by the revision petitioner/Opposite Party no.2, against the order dated 17.10.2019 passed by District Consumer Disputes Redressal Forum-I, UT, Chandigarh, vide which, Opposite Party No.2 was proceeded against exparte.

                Notice of the revision petition was issued to respondent/complainant on the previous date.        

                Sh. Rohit Kumar, Authorised Representative of respondent No.1/complainant   has put in appearance by filing his authority letter, which is taken on record. He has raised his no objection, if the revision petition is allowed and the impugned order is set aside, subject to cost.

                In view of no objection given by Sh. Rohit Kumar, Authorised Representative of respondent No.1/complainant and the facts mentioned in the application, the revision petition is allowed. Order, under challenge, is set aside.  The revision petitioner/Opposite Party No.2 is allowed to join the proceedings before the Forum and file reply and evidence/affidavit before it on the next date of hearing.

                Order passed is subject to payment of cost of Rs.2,000/- by the Counsel for the revision petitioner/Opposite Party No.2, to respondent No.1/complainant before the Forum on the date fixed.

                Today, in Court, the aforesaid cost of Rs.2000/- has been paid by Counsel for the revision petitioner to Sh. Rohit Kumar, Authorised Representative of respondent No.1/complainant.

                In view of allowing this revision petition, the application for stay, aforesaid, stands disposed of.

                Parties/their Counsel are, therefore, directed to appear before the concerned Forum on 09.12.2019.

                Complete record of complaint file be sent back to the Forum concerned alongwith certified copy of this order, so as to reach there before the said date.

                Certified copies of this order be sent to the parties, free of charge.

                File be consigned to the Record Room after completion.
