Present:-    Mr. Sikander Bakshi, counsel for appellant.

                   Mr. Tarshem Chand, respondent/complainant in person along with Mr.              R.S. Sathi, counsel for respondent.

 

                   File taken up today. Miscellaneous Application No.1799 of 2024 has been filed in the registry of this Commission on 05.11.2024. Through this M.A. prayer has been sought for preponement of date of hearing of appeal from 17.02.2025 and disposal of the same in lieu of settlement/affidavit of complainant.

                   Mr. Sikander Bakshi, counsel for appellant has appeared and suffered following statement:-

“Stated that on the instruction of department-appellant (HSVP), present application was filed for withdrawal of present appeal in lieu of compromise/affidavit filed by complainant/respondent that as per policy dated 25.01.2007 amended on 20.08.2019 of HSVP, the interest @ 9% p.a. on the deposited amount is required to be paid to the allottee and the complainant agree to accept the interest on total deposited amount in respect of plot in question @ 9% p.a. as per HUDA policy. I may be permitted to withdraw the present appeal and statutory amount of Rs.8,23,217/- be also be refunded to appellant which was filed at the time of filing of this appeal”.

2.                In view of statement suffered by learned counsel for appellant, present appeal is hereby dismissed as withdrawn. It is ordered accordingly.

3.                Application(s), pending, if any, stand disposed off accordingly in terms of this order.

4.                Statutory amount of Rs.8,23,217/- (Rs. Eight Lacs Twenty Three Thousand Two Hundred Seventeen only) deposited at the time of filing of present appeal be refunded to the appellant against proper receipt, identification and as per rules.

5.                File be consigned to record room.
