Opposite parties No.1 & 2 ex-parte

On 31.8.2015, Sh.Ajay Shanker,Adv.counsel for the opposite party No.3 got recorded his statement that opposite party No.1 is ready to swap the mobile set of the complainant with same model or upgrade model subject to return of mobile set in dispute, original job sheet, original bill alongwith accessories in possession of the complainant within 15 days from today to the service centre. In view of the above statement, today Sh.Gurmeet Singh, complainant got recorded his statement that in view of the statement made by the counsel for the opposite party No.3,he agreed with the same and the Hon'ble Forum may pass adequate order for the time period for compliance of the said statement.

In view of the statements of both the parties, present complaint is disposed of with directions to the complainant that he shall return the mobile set in question, original job sheet, original bill alongwith accessories in the possession of the complainant to the service centre within 15 days from today and opposite party is directed to swap the mobile set of the complainant with same model or upgrade model within one month from the receipt of the old mobile set, original job sheet and original bill alongwith accessories. Copies of the orders be furnished to the parties free of costs. File is ordered to be consigned to the record room.
