Parties are present. Today is for show cause. Accordingly the same is filed. Heard and considered. It is stated that the petitioner failed to follow us at the time of calling their case on previous occasion inattentiveness. We have considered the reason which is explained by Sukla Mukehrjee and Sandip Mukhrjee in favour of both parties respectively. For favourable consideration we have wanted to hear from them but unfortunately they are not present . It is most unexpected particularly in the present situation as exposed from the record.

            In view of the fact and circumstances, we find nothing alternative but to dismiss the case for non prosecution.

                                                            Hence ordered

            That the case be and the same stands dismissed for non prosecution.
