As the M.A. Case being No.  126/2016 has been allowed on contest without any cost and has been held that the Consumer Complaint being no. 43/2016 is not maintainable before this Ld. Forum on the ground of its pecuniary jurisdiction, therefore the Consumer Complaint being No. 43/2016 should be dismissed. Hence, it is

O r d e r e d

that the Consumer Complaint being No. 43/2016 is hereby dismissed without any cost being barred by its pecuniary jurisdiction.

Be it mentioned that the complainant has submitted an application praying for return of the plaint and in our view as the complaint is not maintainable before this ld. Forum, the copy of the plaint be returned to the complainant. The complainant is at liberty to approach the appropriate Forum/Commission seeking redressal of his grievance, if not bared otherwise, in view of the judgment passed by the Hon’ble Supreme Court IN the case of Laxmi Engineering Works Vs. PSG Industrial Institute reported in Vol-II (1995) CPJ (1) SC.

Let plain copies of this order be supplied to the parties free of cost as per provisions of Consumer Protection Regulations, 2005.
