ORDER

Appellant has placed on record copies of order sheets from 08.07.2013 till 22.11.2013. 2. Heard learned counsel for the appellant. 3. Learned counsel for the appellant submitted that on 22.11.2013 appellant could not appear before State Commission as appellant brother was admitted in hospital on 18.11.2013 and was discharged on 22.11.2013 and in such circumstances, complaint was dismissed by the State Commission, which may be restored. 4. Perusal of the record reveals that on 22.11.2013 none appeared before the State Commission. On earlier dates also neither appellant nor other party was appearing before State Commission. Learned counsel for the appellant submitted that his three writ petitions pertaining to same matter were pending before High Court. 5. As complaint has been dismissed in default, we deem it appropriate to restore the complaint at its original number on account of appellant brother illness and admission in the hospital. 6. Consequently, appeal is allowed and impugned order dated 22.11.2013 passed by learned State Commission in O.P. No. 22/2007 S. Venkataraman vs. Tamil Nadu Veterinary & Animal Sciences University & Ors. is set aside, subject to depositing Rs.5,000/- as cost with the Legal Aid Fund of the State Commission and complaint is restored at its original number. 7. Appellant is directed to appear before State Commission on 01-04-2014 and learned State Commission is expected to proceed in accordance with law.
