Smt. K.G.SHANTALA, Member. --- Consumer Complaint No.24/2008 Between:- Karnataka State Co-operative Consumers Federation Limited, Myakalappa Complex, Brahmin’s Street, Kolar. Fundtioning in the name and Style of Janatha Bazaar, Rep: by its Branch Manager. Complainant (By Advocate Sri. P.S.Ranganathan) V/s 1. Kolar Taluk Social Welfare officer, Kolar Taluk Social Welfare Office, Kolar. Rep: by its Taluk Officer. 2. District Social Welfare Officer, Kolar District, Kolar. Opposite parties (OP-1 In person) (OP-2 In person) ORDER This is a complaint under section 12 of the Consumer Protection Act, 1986 praying for a direction to pay Rs.9,95,221/- towards the dues for the goods / study materials supplied by complainant to various residential hostels run by opposite parties with costs and interest. 2. The material facts may be stated as follows: That the complainant supplied toiletry and study materials to various residential hostels run by OPs in Kolar Taluk during 2006-07 and raised bills for the price of those things. It is alleged that the amount stated above is still due from OPs and the non-payment for a long time has caused undue hardship to the complainant. The details of bills raised and the payment received are stated in the complaint. The complainant stated that it has rendered services to the students of residential hostels at the request of OPs. Therefore they prayed for a direction for payment of the amount due. 3. The OPs appeared but their versions are not filed. The office Manager of OP-1 who was present before the Forum on 21.07.2008 when questioned admitted that the amount claimed in the complaint was due and the same was not paid due to non release of Government grant and the said amount would be paid within short time as the release of CC No.24/2008 grant is under process. The said officer Manager requested a month time for clearing the dues. In view of the above admitted facts we pass the following: O R D E R The complaint is allowed. The opposite parties shall pay Rs.9,95,221/- (Nine Lakh Ninety Five Thousand Two Hundred Twenty One only) to complainant within one month from the date of this order. In default the complainant is entitled to file execution application for recovery. Dictated to the Stenographer, corrected and pronounced in open Forum this the 24th day of July 2008.
