JUDGMENT
Complainant has filed the consumer complaint U/s.35 of Consumer Protection Act, 2019 seeking following relief;
“Direct the opposite party to supply the certified copy as per the application and pay Rs.50,000/- towards compensation and also pay Rs.20,000/- towards cost of litigation.”
Brief fact of the case of complainant is that, the complainant is a senior citizen filed an application for obtaining certified copy of lease case No.160/2007 before the Tahasildar, Tirtol on 24.12.2020 and as the case record was not available in Tirtol Tahasil, the said application was send to Raghunathpur Tahasil. Since 24.12.2020 from Tirtol Tahasil to Raghunathpur Tahasil from his residence, complainant travelled several time in a month and invested huge money towards travelling expenses and also filed application one after another by investing huge money but at last the Tahasildar, Raghunathpur on 30.12.2022 reused to supply the copy required by the complainant.
Notice to opposite party was sent by Regd. Post but the opposite party did not appear and was set ex-parte vide order dtd.08.12.2023.
Complainant has paid consideration in shape of fees for grant of certified copy not once but twice i.e. on 01.3.2021 and 24.9.2021. The record of which the certified copy was sought for was transferred from office of Tahasidar, Tirtol to office of Tahasildar, Raghunathpur but certified copy has not been granted and no reply has been filed by opposite party in respect to our Regd. Notice. As such we are satisfied that opposite party is negligent in supplying/granting certified copy for which complainant has paid consideration in shape of Court fees as such the opposite party is directed to grant the certified copy of documents sought for by complainant and opposite party is also directed to pay Rs.5,000/- as mental agony and Rs.2,000/- as cost of litigation. The opposite party is free to recover the amount from the officer/official at fault to grant the certified copy and pay the same to complaint within 2 months from the date of passing of the order. Send a copy of the order to opposite party for compliance.
