Heard the ex-parte submissions advance by Complainant, as Ops did not prefer to appear into the dispute. It is case of the Complainant that, he had deposited Rs. 160/- for demarcation of his land over Plot no. 307,308 & 309 in respect of Khata No.55, Mouza- Mahakalpada before Op No.1 Tahasildar, Mahakalpada and his application is registered as Demarcation Case No. 138/2017. It is also the case of the Complainant in respect of payment of consideration amount of Rs. 160/-, he obtained money receipt bearing No. 2/2017-18 on dt. 9/5/2017 and inspite of his bestefforts and requests, the Ops are not deputing the Amin to demarcate the aforesaid land. In support of his submissions Complainant filed attested Xerox Copies of money receipts bearing No. 613945 granted by Op No.1, Tahasildar, Mahakalpada and attested Xerox copy of R.O.R. and rent receipt of the said Plot.
Considering the submission and on perusal of documents, further on non-appearance of Ops, it is clear that, Complainant has paid a consideration amount of Rs. 160/- on dt. 9/5/2017 to avail the ‘Service’ of Op No.1 for demarcation of his land. Which accordingly to us is deficiency in service of Op No.1, Tahasildar, Mahakalpada.
Accordingly, it is directed that within one month of receipt if this order Op No.1, Tahasildar, Mahakalpada shall make necessary arrangement as per the official norms to demarcate the land of the Complainant situated over Plot No. 307,308 & 309 corresponding Khata No. 55 of Mouza- Mahakalpada, on its non-compliance, matter to be brought into the notice of Op No.2. Sub-Collector, Kendrapara and the grievance of the Complainant is to be redressed by Op No.2 within one month of receipt of the complaint. Non-compliance of order will initiate proceeding as per the provisions of C.P.Act, 1986.
Complaint is allowed in-part on ex-parte without cost.
