Final Order / Judgement

Complainant being present filed hazira. Heard the ex-parte submissions by Complainant as non-appears on behalf of the Op. It is the case of the complaint that, in order to demarcate his land bearing Plot No. 685,686,688 correspondence to Khata No. 174,Plot No. 690,992 of Khata No. 181/21 and Plot No. 395 of Khata No.173 of Mouza- Pimpudi applied before Tahasildar, Kanika, on demarcation Case No. 76/2017, 77/2017 and 78/2017. It is also the case of the Complainant that inspite of deposit of required fees and after obtaining the money receipts, the Op-Tahasildar is not deputing the Amin to demarcate the schedule land for which the complaint is suffering mental agony and other land related problems and preys this Forum to issue direction to Op-Tahasildar for demarcation of his land.

                  Considering the submissions and on perusal of documents i.e, attested Xerox copy of demarcation application dtd. 25.01.2017 alongwith attested Xerox copies of money receipts dtd. 26.05.2017 vide M.R. No. 098297 to 299, it is clear that Complainant is an applicant before the Op-Tahasildar for demarcation of his land and the Op-Tahasildar has not complied to demarcate the land, till filing of the present complaint, reason best known to the Op-Tahsildar.  As the complaint is non-rebuttal in nature, this Forum is accepted the prayer of the Complainant.

            Accordingly, it is directed that, the Op-Tahasildar within 2 (two) months of receipt of this order shall make necessary arrangements to demarcate the Plot of the Complainant as per demarcation case No. 76/2017,77/2017 and 78/2017, on compliance of other procedure failing to comply the order will initiate proceeding against the Op under the provisions of C.P.Act-1986.

                      Complaint is allowed in-part on ex-parte without any cost.

                     Pronounced in the open Court, this the 6th day of August, 2018.
