ORDER

JUDGEMENT DELIVERED BY

The complainant has filed this Complaint against the Opposite Party (herein after referred in short as OP) u/s 12 of Consumer Protection Act, 1986 alleging deficiency in service against OP. 

 

2.    The brief fact of the case is that the Complainant is an agriculturist and he had applied for survey for his agricultural land from OP. He has paid the fees for the same on 21.01.2015. But, OP have failed do his work. Hence, this Complaint.

 

2.  The Forum received a Complaint and heard on admission. The notice was ordered as such OP appeared In-person and filed Written Version. In the meantime OP prayed time to measure the agricultural land and to file the report of the same. Time was granted to OP to measure the land, The OP had completed his work and filed a report to the forum and Complainant filed a Memo stating that he is satisfied the report, but pray to Order compensatory cost.

 

3.      Hence, this Forum observed that the OP had delayed in measuring the land of the Complainant only after issuing the notice from this Forum OP came forward to do his work, done. Hence, OP is liable to pay Rs.5,00/- towards litigation charges to the Complainant. The OP is directed to comply this Order within a period of 15 days from the date of this Order, failing which OP has to deposit amount of Rs.5,000/- to the Legal Aid Account.
