ORDER

By Smt. Padmini Sudheesh, President: The petitioner’s case in brief is as follows: 2. As per the general offer in Malayala Manorama daily dated 9.10.07, that Scorpio Vehicles are for sale for a price of Rs.79,750/- with six additional benefits, naturally enthused by the offer, the petitioner went over to the respondent in Bye-Pass Road, Mannuthy with money sufficient to pay the price of the Scorpio according to the advertisement plus tax, insurance, etc. on the 9th October 2007 with a view to take delivery of the vehicle. But the respondent refused to deliver the vehicle and also rebuked the petitioner addressing on his gullibility. Notice was sent to the respondent on 10.10.07. No reply was addressed. Hence the petition. 3. In this case notice was issued and the respondent accepted it on 15.11.07. The respondent never appeared before the Forum. He deliberately avoided the order of the Forum. So on 20.2.08 the respondent is called absent and declared exparte. 4. To prove the petitioner’s case, the petitioner has filed affidavit and the documents marked as Exts. P1 to P3. Heard the Counsel. 5. As per the case of the petitioner he is entitled to get the Mahindra Scorpio, Ramzan offer, with all the notified benefits by collecting Rs.79,750/- only. There is no counter evidence to the evidence of the PW1. In this case the respondent committed serious unfair trade practice and that has to be compensated by him. 6. In the result, the petition is allowed and the respondent is directed to deliver the Mahindra Scorpio, Ramzan offer with all the notified fringe benefit by collecting the said cash. The petitioner is also entitled to get Rs.2500/- (Rupees two thousand and five hundred only) as compensation for mental agony and Rs.500/- (Rupees five hundred only) towards costs. Comply the order within one month. Dictated to the Confidential Assistant, transcribed by her, corrected by me and pronounced in the open Forum, this the 27th day of March 2008.
