          The appellant is the opposite party represented by its Managing Director. The appellant is a public sector undertaking. The matter has been disposed of with the appellant as ex-parte. The case of the complainant is that the complainant had an agreement with the opposite party for supplying herbs. The tenure of the agreement was one year. The complainant had collected herbs for supplying to the opposite party. But no order was placed and the period of agreement is over.
          The evidence adduced consisted of the testimony of Exts. P1 and P2.
          The complainant had claimed Rs.90,000/- as compensation and costs. The Forum considered the matter and held that the absence of concrete evidence as to the stocking of the products   the compensation of R.10,000/- alone and costs of Rs.1000/- is to be awarded.
          It is mentioned in the appeal memorandum that the appellant happened to be ex-parte on account of change in office regarding conduct of the case and hence the appellant could not prosecute the case. We find that the reason mentioned in the affidavit before the Forum is not properly explained. We find no reason to set aside the order of the Forum. The appeal is dismissed in limine..
