The appellants are the opposite parties/KSEB in CC.258/09 in the file of CDRF, Ernakulam.  The bill issued by the opposite parties/appellants stands set aside.

2.  It is seen that the opposite parties have not adduced any evidence before the Forum.  The matter relates to the alleged unauthorized extension.  Evidently the Forum has not considered the same.  The opposite parties have not produced even the mahazar prepared.  In the circumstances we find that a considered order after examining the relevant records is required.  Hence the order of the Forum is set aside on condition that the opposite parties pay a sum of Rs.5000/- to the complainant towards costs.  On payment of cost the Forum will permit the opposite parties to adduce evidence and also the complainant to adduce further evidence if any and dispose of the matter on merits.

The case stands posted before the Forum on 22/12/2010.

Office will forward the copy of this order to the Forum urgently.
