SRI.K.T.SIDHIQ, PRESIDENT

            Complaint alleging  Unfair trade practice on the part of opposite party.  According to complainant the opposite party supplied low quality Irool wood for the price of high quality wood.  Hence the complaint.

2.            Opposite party defends the complaint and contended that the complainant himself came along with a carpenter and selected wood materials of various quality.  The total bill was Rs.41,660/-.  But the complainant paid only Rs.20,000/-.  The opposite party approached the complainant several times claiming the balance amount.  Finally due to the intervention of mediators an agreement was executed as per which the complainant was liable to pay Rs.9000/- to the opposite party on or before 9-12-07.  The said amount also not paid.  Hence the said agreement is not in force and the complainant is liable to pay Rs. 21,660/- towards the balance amount due to opposite party with interest.  The averment regarding quality of wood is only to evade payment.  Therefore opposite party prays for the dismissal of complaint.

3.            Neither the complainant nor the opposite party tendered any evidence.  No documents are also produced.  There is absolutely no materials produced by the complainant to prove his allegations.  No steps are also taken by the complainant to prove his case. 

            In the result complaint fails and hence dismissed with no order as to costs.
