ORDER

        In the Execution Petition filed by the respondent, State Commission issued the notice for 4.10.2012 requiring the petitioner to appear in person or through a counsel.  On 4.10.2012, petitioner appeared through a counsel.  In spite of that, State Commission has issued bailable warrant against the petitioner as the petitioner was not present.

 

        Counsel for the petitioner states that since the petitioner was represented through a counsel, State Commission was not justified in issuing bailable warrant.  We find substance in this submission.  Since the petitioner was represented through a counsel, there was no justification to issue the bailable warrant.  In case, State Commission requires the petitioner to be present in person, it can pass an order requiring the petitioner to be present in person.

        Revision petition is allowed and disposed of accordingly.
