FINAL ORDER/JUDGEMENT.

Complt. files hazira through Ld. Advocate. The case is fixed for hearing. No step is taken by the O.P. who is found absent on repeated call.

The Complt. case is that he purchased a kitchen chimney for RS.18,193/- from O.P under cash memo. Dated 01.07.2020 with an advance payment of Rs.10,000/- and Rs. 8,000/- after installation. But after 29 days of installation technical defect (Oil drop) of the Chimney was found and the same was intimated to the O.P for proper service and maintenance O.P / Company though repaired the same but it did not work after 7 days and thereafter O.P did not attend for removal of defects despite several reminder and persuasion. The Complt. has therefore approached this commission for refund of the Price of the Kitchen chimney or replacement of the defective chimney by a new one.

Perused the Petition of Complt. and all the relevant documents on record. Heard the Ld. Advocate for Complt. prima-facie case of the Complt. is established. O.P being the product seller has the bounden duty to deliver and install the product without any complain otherwise it will amount to deficiency in service for delivery of defective product without proper service and maintenance. The Complt is entitled to get the relief as prayed for.

 

Hence it is,

Ordered.

that the case be and the same is allowed exparte against the O.P but without cost. Both O.Ps are directed jointly and severally to pay to the Complt. Rs. 18,193/- with litigation cost Rs.10,000/- after taking return delivery of the defective machine or to replace the defective chimney by a new one of the same price within a month from this date in default law will take his own course.
