ORDER

Present :      Sh. Nimish Chib, Counsel for the Complainant.

 

          The complaint has been filed on the allegations that both the complainants booked two flats in joint name in the project of OP at Dharuhera, Sector-5, District Rewari (Haryana).  As per para 3 of the complaint, the distance between said project from Delhi where complainants are residing is 75 Kms.  The booking of two flats shows that complainant purchased the flats for investment.  In any event, they could have resided in one flat and other flat meant for sale by earning profit.

 

          The counsel for complainant pointed out that complainants have alleged in para 5 of the complaint one flat was meant for complainants and other for children. The age of the children have not come to show after how much  period they would be required the flat for independent residence.

 

          Further complainants have made six prayers. The first prayer is for assured rent of Rs.7,48,800/- from July, 2015 till February, 2016. The second prayer is for assured rent of Rs.2,35,824/- from 01.07.2014 to 30.06.2015. The third prayer is for assured rent for Rs.2,80,800/- from 01.04.2014 to 01.07.2014 alongwith interest @24% per annum, the same would come to Rs. 1,00,000/-. The fourth prayer is for Rs.65,73,000/- with interest @24% per annum with pendent lite and future interest from 01.10.2010. The same would come to Rs.78 lacs approximately. Even if interest is not granted @24%, it may be 18% or 12%. Still it would come to around  Rs.39 lacs. This figure taken with Rs.65.76 lacs itself exceeds Rs. One crore.  Fifth prayer is for Rs.10,00,000/- for compensation and Rs.1,00,000/- for cost of litigation.  All the prayers taken together exceeds the pecuniary jurisdiction of this Commission.

 

          The complaint is dismissed.
