JUDGEMENT

This complaint has been filed under Section 12 of the Consumer Protection Act, 1986 by Shri Mohit Gupta against Systech Recruitment Services (OP).

2.        Facts in brief are that the complainant contacted OP for overseas job.  He was assured by the officer of OP that he could get job in 2 months by paying Rs. 9,000/-.  The receipt was issued to the complainant for Rs. 7,000/-, but no receipt with respect to payment of Rs. 2,000/- was  issued despite demand. 

Even after 2 months, the complainant could not get job as assured by OP.  The complainant was promised that amount would be reversed to the bank account of the complainant bearing no. 30802198326.  However, despite email dated 02.04.2015, the said amount has not been reversed.  Hence, the present complaint alleging unfair trade practice and deficiency in services against OP, with prayer of directions to OP to refund Rs. 9,000/-, compensation for harassment and mental agony and Rs. 15,000/- as cost of litigation.  Receipt dated 02.01.2014 for Rs. 7,000/- is annexed with complaint. 

3.        OP was served with notice of the complaint, but none appeared, thus they were proceeded ex-parte.

4.        Evidence by way of affidavit was filed by the complainant, where he examined himself.  He has narrated the facts, which have been stated in the complaint.

5.        We have perused the material placed on record.  The receipt annexed with the complaint reveals that the complainant was lured to pay Rs. 7,000/- in lieu of a job, but OP has failed to provide services as promised.  As, OP did not put appearance and all the allegations made by the complainant have remained unrebutted thus the present complaint is allowed with the directions to OP to refund Rs. 7,000/- alongwith interest @ 6% from the date of filing of the present complaint.

            We further award Rs. 2,000/- as compensation for harassment and mental agony and Rs. 1500/- towards cost of litigation.  If OP fails to pay the total amount of Rs. 10,500/- within 30 days from the receipt of this order, he shall be liable to pay 9% interest on the above said amount from the date of filing till realization.

Copy of the order be supplied to the parties as per rules.

File be consigned to Record Room.
