The complainant is present by filing hazira.
The case is fixed for Ex-parte hearing.
No step is taken by the O.P.s
The Complainant’s case is that he purchased on 05-09-2020 a Laptop with one year warrantee from O.P. No.2 for Rs.95,000/- under proper receipt but within the warrantee period due to some accidental mishap the screen of the Laptop got damaged for which he contacted O.P. No.1 for repair and service of the Laptop. The Complainant was to pay an amount of Rs.22,948/- for servicing and repairing of the Laptop [HP LAPTOP 13-BA0010TX(35099PA)] through the untrained Technician of O.P. No.1and ultimately the Laptop went out of order completely due to mishandling and poor servicing by the concerned Technician. The Complainant has therefore prayed for refund of the price of the Laptop being Rs.95,000/- along with repairing cost of Rs.22,948/- Contd…….p/2

The Commission has examined the facts of the case and all the material documents on record. It may be mentioned here that in spite of sincere efforts the attendance of O.P.s could not be secured. None of the O.P.s are interested to contest the case for the simple reason that they have no defence to deny the claim of the Complainant. It is the duty of the Product seller and Service provider to take care of the service and repairing of any defective product sold to the customer. Failure to discharge such legal duty against the interest of the customer is tantamount to deficiency of service for which the O.P.s are liable to compensate the loss and damage caused to the Laptop in question.
Prima-facie case of the Complainant is established.
Hence it is ordered…..
That the case be and the same is allowed Ex-parte against both O.P.s
O.P.s are directed jointly and severally to pay to the Complainant Rs.95,000/- plus 22,948/- together with compensation of Rs.10,000/- within one month from this date failing which the decretal amount may be realized in due process of law.
