HON’BLE JUSTICE SHRI. S.S. SATHEESACHANDRAN: PRESIDENT

          Appeal is filed by the complainant whose complaint was dismissed for default.  Appeal is presented with a petition to condone delay of 79 days is against the Order dated:8.8.2017 in CC.446/16 passed by the CDRF, Thiruvananthapuram. 

2.      The dismissal of the complaint for default will not bar the complaint from filing a fresh complaint on the same cause of action provided it is within time, showing the circumstances under which the previous complaint was dismissed.  Without prejudice to the right of the complainant to file a fresh complaint if so advised, delay condonation petition is dismissed and appeal is rejected.
