ORDER

Complainant present in person. Hearde the complaint on maintainability. Short point for our consideration is as under:- Whether this complailnt is maintainable under the provisions of C.P.Act, 1986? It is the case of complainant that he had brother-in-law named B.N.Nanjundaiah, who died on 20.12.2003. Lt.Nanjundaiah had S.B.Account No.1362 in the Syndicate Bank (O.P.Bank), Saraswathipuram, Mysore. Lt.Nanjundaiah had executed the will dead in favour of the complainant on the basis of which he is entitled tod receive the amount from the O.P.Bank inspite of notice dated 27.07.2005, there is no reply or repayment, hence this compliant. Obviously, the complainant is not a consumer because he has neither opened any account nor operated account no.1362, This Forum can not adjudicate right of a person raising out of the will deed. Hence, following order:- Complaint is rejected as this Forum has no jurisdiction. Complainant is at liberty to approach proper court. Give a copy of this order to the complainant.
