Final Order / Judgement | Case called. Complainant as well as OP and their respective learned counsel are present, who filed joint Memorandum of Settlement stating the matter is settled out of court. The said Memorandum of Settlement is duly signed by complainant as well as the OP so also their respective counsels. The contents of the Memorandum of Settlement are read over the listed on the memo and explained to the parties, who admits that the contents of the Memorandum of settlement are true and correct. For better appreciation we would like to extract the contents of the Memorandum of Settlement which read as thus: Both parties respectfully submit as follows: 1) | Opposite party admits the claim petition of Complainant and agrees to repay the Principal amount in 4 installment once in three months. | 2) | The First Installment of Rs.75,000/- (Rs.Seventy Thousand Only) towards principal amount will be paid on or before 20th January 2019 and remaining in three equal instalment. | 3) | The Complainant agrees to receive the interest on Principal amount upon opposite party getting substantial amount from the developer. | 4) | Complainant has the executable rights if the settlement agreed is not fulfilled by Opposite party. | 5) | Complaint may be closed as settled out of court. |
Ongoing through the contents of the Memorandum of Settlement, we do not find any legal impediment to allow the said Memorandum of Settlement. Accordingly it is allowed. It is made it clear that, any of the terms and conditions, if found to be violated by the parties to the lis they are at liberty to take appropriate steps. Accordingly, the Memorandum of Settlement is allowed. The matter is disposed off as settled in terms of the Memorandum of settlement as stated above. Looking to the circumstances of the case, both parties are directed to bear their own cost. (Dictated to the Stenographer in the open forum and pronounced on 08th January of 2019). | |
