O R D E R SRI. P.V SINGRI, PRESIDENT All these complaints have been filed by the different complainants against one and the same OPs and the issues involved in all these complaints are one and the same. Therefore, all these complaints have been taken up together for disposal under this common order. 2. The complainants have filed these complaints U/s.12 of the Consumer Protection Act, 1986 with a prayer to direct the OPs to refund them the amount invested/paid by them under in various schemes floated by the OPs together with interest, compensation and cost of litigation. 3. The averments made in all these complaints are almost similar except the quantum of money invested/paid by each one of them. It is alleged by the complainants that OP-1 is a Director/Proprietor of Swarna Krishi Farms India Pvt. Ltd., having its registered office in Shabari Nagar, Byatarayanapura, B.B Road, Bangalore and the same is incorporated under companies Act, 1956. That one B.Thammegowda is a chairman of OP-1. OPs in their prospectus invited the public to invest in various schemes including accidental insurance, shares, pigmi account etc., promising huge interest and lured by such advertisements the complainants invested money in various schemes floated by the OPs. One of the schemes is to deposit small sums of money ranging between Rs.20/- to Rs.500/- per day in pigmi account. Another scheme is to deposit various amounts ranging between Rs.5,000/- to Rs.1,00,000/-. In all these schemes OPs promised attractive interest. The complainants have invested money both in pigmi accounts by depositing amounts as shown in the following table and some of the complainants have invested in fixed deposits for period ranging for one into three years as shown in the following table. Later on the complainants came know that the OPs have started a society under the name and style ‘Swarnashakthi Multipurpose Souharda Co-operative Limited.,’ in the same office premises with the same office bearers causing confusion among the investors. Later on the OPs stopped the business of the company and failed to refund the money invested by various investors. That the complainants repeatedly requested the OPs to refund the money invested by them but the OPs did not respond to their request. That the complainants have invested huge money by borrowing the same from their friends and relatives. That the OPs after having stopped business of the company have shut their office. That the complainants thereafter got issued legal notice to the OPs on different dates but the notice so sent to OP-2 through their advocate returned as ‘addressee left’. Though the legal notice was served on OP-1, he did not care to respond to the notice and failed to refund the money invested by the complainants. Therefore, the complainants got issued one more legal notice to both the OPs by post as well as through e-mail but the OPs failed to respond to the same. 5. That the conduct of OPs has caused serious anxiety, hardship and inconvenience to the complainants as they are unable to get their money back together with interest as promised by the OPs. Therefore, the complainants prays for an order directing the OPs to refund the amount deposited/invested by each one of them together with interest @ 24% p.a and 18% p.a compensation for deficiency of service together with cost of litigation. 6. The notices sent to the OPs.1 & 2 were not claimed by the OPs despite intimation by the postal authorities. Therefore, OPs have been placed ex-parte. 7. To substantiate the allegations made in each of the complaints, the complainants have submitted their affidavit evidence reiterating the allegations made in the complaint. Each of the complainants together with complaints have submitted the copies of FD receipts/deposit receipts/pigmi receipts for having invested/paid amount regularly in the accounts opened with the OPs beginning from January - February 2013. 8. As stated above, OPs failed to appear and contest the complaints. OPs neither filed their version nor affidavit evidence denying the allegations made against by them by each one of the complainants. We don’t have any reasons to disbelieve the allegations made in the complaint as well as the sworn testimony of each of the complainants. An inference can be drawn from the conduct of OPs in not contesting the complaints despite service of notice that they admit the claim put forth by each one of the complainants. The OPs have invited the public to invest in various schemes floated by them promising attractive rate of interest and other benefits and believing the words of the OPs, the complainants have invested huge amounts with a fond hope that they will earn good returns. However, the OPs having collected huge sums of money from the complainants and others have stopped business and have eloped with money invested by the complainants and several others thereby causing great hardship, inconvenience and mental agony to the complainants. The allegations made in the complaints coupled with sworn testimony of each of the complainants and the documents produced by each one of them establishes that each of them have invested/deposited monies as shown against their names in the above mentioned table. The OPs are liable to refund the said amount to the complainants. Since the OPs have retained the above said amount illegally all these days, they are liable to pay interest @ 18% p.a. Furthermore the OPs are also liable to pay adequate compensation to each of the complainants for deficiency of service resulting in hardship, inconvenience and mental agony to the complainants. 9. In the result, we proceed to pass the following: O R D E R The complaint Nos.565/2016, 566/2016, 567/2016, 568/2016, 569/2016, 570/2016, 650/2016, 651/2016, 652/2016, 653/2016, 654/2016, 655/2016, 656/2016, 657/2016, 658/2016 & 659/2016 are filed by the complainants U/s.12 of the Consumer Protection Act, 1986 are allowed in part. The OPs are jointly and severally directed to refund a sum of Rs.7,752/- to the complainant in complaint No.565/2016 together with interest @ 18% p.a from the date of actual receipt till the date of realization. Further OPs are directed to pay compensation of Rs.3,000/- together with litigation cost of Rs.3,000/-. The OPs are jointly and severally directed to refund a sum of Rs.9119/- to the complainant in complaint No.566/2016 together with interest @ 18% p.a from the date of actual receipt till the date of realization. Further OPs are directed to pay compensation of Rs.3,000/- together with litigation cost of Rs.3,000/-. The OPs are jointly and severally directed to refund a sum of Rs.3,550/- to the complainant in complaint No.567/2016 together with interest @ 18% p.a from the date of actual receipt till the date of realization. Further OPs are directed to pay compensation of Rs.2,000/- together with litigation cost of Rs.3,000/-. The OPs are jointly and severally directed to refund a sum of Rs.15,351/- to the complainant in complaint No.568/2016 together with interest @ 18% p.a from the date of actual receipt till the date of realization. Further OPs are directed to pay compensation of Rs.3,000/- together with litigation cost of Rs.3,000/-. The OPs are jointly and severally directed to refund a sum of Rs.74,004/- to the complainant in complaint No.569/2016 together with interest @ 18% p.a from the date of actual receipt till the date of realization. Further OPs are directed to pay compensation of Rs.8,000/- together with litigation cost of Rs.3,000/-. The OPs are jointly and severally directed to refund a sum of Rs.1,41,200/- to the complainant in complaint No.570/2016 together with interest @ 18% p.a from the date of actual receipt till the date of realization. Further OPs are directed to pay compensation of Rs.10,000/- together with litigation cost of Rs.3,000/-. The OPs are jointly and severally directed to refund a sum of Rs.18,360/- to the complainant in complaint No.650/2016 together with interest @ 18% p.a from the date of actual receipt till the date of realization.
