Hon'ble Shri Ajeya Matilal, Presiding Member

The Learned Advocate for the revisionist is present.

OPs  and respondents are present in person.

In the instant revision petition the OPs of CC/405/2022 prayed for setting aside  the Order No. 8 dated 17.07.2023 passed by DCDRC, Unit- III closing the opportunity for filing affidavit in chief by the OPs.

Learned Advocate for the revisionist submitted that on the date fixed before the Learned Forum below, the revisionist could not take any steps because of his  late arrival before the Forum below.

Heard both sides. Considered.

It appears that an opportunity should be given to the present revisionist to contest the case, otherwise the opportunity of being heard for him would be denied.

So, the impugned order requires interference from this Commission.

Hence it is ordered :

The revision petition is allowed on contest with cost of Rs. 3000/- payable to each of the respondents @ Rs. 500/-.

The parties are directed to appear before the forum below on 07.03.2024 before the Hon’ble DCDRC, Unit III  and the revisionist shall pay cost to the respondents on that date.

The Learned Forum below is requested to dispose of the case after giving the opportunity of being heard to both the parties and dispose the same within 3 months preferably within three months from the said date .

Let a copy of this order be sent to the Learned Forum below for information and necessary action.
