ORDER

1.   Heard. This order shall dispose of the review application filed by applicant/OPs for the review of the order dated 14.03.2024 passed by this Commission in CC/594/2022. It transpires from the averments as projected in the application that in fact the complainant had taken physical possession of the said unit on 21.9.2019 and tendered his undertaking Annexure R-9 and affidavit Annexure R-10 to the OPs affirming his satisfaction in respect of the unit in question and while deciding the aforesaid complaint vide order dated 14.03.2024, inadvertently amount of delayed compensation @ 9% interest to the complainant on the entire deposited amount w.e.f. the promised date of possession i.e. 26.9.2018 till 21.9.2021 was typed instead of ‘21.9.2019’ i.e. date the possession was actually handed over to the complainant and said necessary correction be made in the main order passed by this Commission in CC/594/2022. The application is supported with affidavit of the official of the applicant/OPs.

2.   Copy of the application supplied to the counsel for non-applicant/complainants. However, the learned counsel for non-applicant/complainants has made no objection in case said necessary correction as prayed for by the applicant/OPs be allowed by reviewing the impugned order dated 14.03.2024.

3.   In view of the no objection made by counsel for non-applicant/complainants and also that complainant is entitled for the delayed compensation alongwith interest till the actual possession was handed over to him i.e. till 21.9.2019, the miscellaneous application in hand stands allowed and the impugned order dated 14.03.2024 passed in CC/594/2022 is reviewed and para No.10(i) of the order dated 14.03.2024 is modified to the extent that date ‘21.9.2019’ be read in place of ’21.9.2021’.

4.   The record of this miscellaneous application No.40 of 2024 be tagged with the consumer complaint No.594 of 2022 and on the margin of page No.7 of the final order dated 14.03.2024, an endorsement be made that in para No.10(i), in the 5th line, date be read as ‘21.9.2019’ in place of ’21.9.2021’ and reference of the order passed in this miscellaneous application No.40 of 2024 be also given under signatures of this Commission on the margin and thereafter fresh certified copies of the order be sent to the parties free of charge. This miscellaneous application stands disposed off accordingly.

5.   Certified copies of this order be sent to the parties free of cost.
