Smt. UshaSachdevanamed above here in the complainant has filed the present consumer complaint against Sh. SushilMohindra ( discharged vide order dated 09.11.2010.) and Arundev Builders Pvt. Ltd. herein after in short referred as the opposite party for directions to the opposite party to pay interest @ 18% for the period 23.02.2010 to 21.10.2010 an amount of her plot no. 8117 at Haridwar and on amount of Rs. 2,66,000/- of her plot no.13107 situated at Shahpurafrom 15.12.2006 to March 2009 andcompensation of Rs. 10,00,000/- on account of fraud and harassment on the part of the opposite party.
Notice of the complaint was issued to the opposite parties. Sh. SushilMohindra was discharged by this Forum vide order dated 09.11.2010.
The opposite party filed reply to the complaint.
It is worth mentioning here that on 09.11.2010 this Forum passed the following order:-
“Complainant admits that she has no dues against agent OP-1 who was a middleman and she has no grievance against OP -1. Hence OP-1 isdischarged from the case.
OP -2 has promised to make the payment of total amount Rs. 3,45,000/- with interest @ 12% p.a. from Feb. 2010 to Dec. 2010. The amount ofRs. 69,000/- is being paid through cheque /Draft dt. 8/11/2010 today which is the interest on Principal amount till Feb. 2010 @ 9% p.a. as earlier agreed. Any discrepancy in calculation about this cheque shall be taken care by OP.
Now come up on 21/12/10 for payment as agreed by OP.”
On 21/12/2010 this Forum passed following order:-
“Advocate for OP’s seek time for payment till Feb first week , list again on 15/02/2011.”
On 15.02.2011 this Forum passed the following order:-
“Counsel has filed calculations regarding interest.
Today OP2 has delivered a Bank Draft for Rs. one lac for complainant and undertakes to pay the balance on next date and prays for a date in March. Adj. for 15.03.2011 for payment of balance amount.”
This Forum on 15.03.2011 passed following order:-
“Comp has today delivered a Bank Draft of Rs. 1,25,000/- by counsel for OP 2 as part payment. One more adjournment sought for further payment. Adj. to 28.04.11 for payment of balance amount with due interest.”
On 28.04.2011 this Forum passed the following order:-
“Parties are directed to file their separate calculations alongwith affidavit to show what amount is still due to the complainant from OP . Put up on 6/05/2011.”
This Forum on 06.05.2011 passed following order:-
“At this stage OP appears through Mukul Kumar. Both the parties have filed the details. Parties to check the details of each other and then came on 10/05/2011 if settlement is materialized failing which case shall go further.”
This Forum on 10.05.2011 passed the following order:-
“List for further arguments on 05/07/2011.”
This Forumon 5.07.2011 passed the following order :-
“For WS put up on 29/9.”
From bare reading of the complaint, reply, orders dated 09.11.2010. 21.12.2010, 15.02.2011,15.03.2011, 28.04.2011, 06.05.2011, 10.5.2011 and 05.07.2011 and calculations submitted by the parties it is evident that the dispute between the parties was settled on 21.12.2010 and as per the settlement the opposite party agreed to pay Rs. 3,45,000/- with interest @ 12% p.a. from February 2010 till December 2010. Outof whichRs. 69,000/- were paid by the opposite party on 09.11.2010 vide cheque dated 08.11.2010 as interest till February 2010 on the principal amount.
The opposite party on 15.02.2011 paid Rs. 1,00,000/- through bank draft to the complainant. The opposite party on 15.03.2011 paidRs. 1,25,000/- vide bank draft. The complaintwas adjourned to 28.04.2011for balance payment. On28.04.2011 the parties weredirected to submit their calculation supported by affidavits. The parties submitted their calculations. As per the order dated 09.11.2010 a sum of Rs 1,20,000/- and interest @ 12% p.a. from February 2010 remained unpaid by the opposite partysto the complainant. Therefore, it is evident that as per the settlement dated 09.11.2010 the amount payable by the opposite party remainedRs. 1,20,000/-, interest @ 12% p.a. on total sum of Rs. 3,45,000/-( Rs. 1,00,000/- paid on 15.02.2011 and Rs. 1,25,000/- on 15.03.2011). The opposite party has failed to pay the agreed /settled remaining amount of Rs. 1,20,000/- and interest,therefore, there is unfair trade practice and deficiency in service on the part of the opposite party.
Hence we direct the opposite party to pay Rs. 1,20,000/- with interest @ 12% p.a. from February 2010 till actual realization and pay interest @ 12% on total sum of Rs. 3,45,000/- from February ,2010 to 15.03.2011 .
