HON’BLE JUSTICE SRI A. CHAKRABARTI, PRESIDENT.

 

This appeal was filed challenging the order dated 29.08.2008 passed by the Calcutta Unit – II in CC No. 162 of 2008 allowing the complaint and directing the O.P. – C.E.S.C. Ltd. to install new separate domestic A.C. connection at the residence of the Complainant at the premises involved provided the Complainant arranges for suitable site for this and pays necessary charges and observes formalities as per the O.P.’s rule.  Mr. Mukherjee, the Ld. Advocate for the Appellant contends that his client having no free access to the premises concerned and, therefore, is facing difficulty in implementing the order for which an inspection is also required.  No one appears for the Respondent.  We have considered the contention and perused the materials on record.  We find that as the direction has been given for installing a new separate domestic A.C. electric connection at the residence of the Complainant provided the Complainant arranges for the suitable site for this and pays necessary charges and observed formalities as per the O.P’s Rule, no protection is required for the Appellant for implementation of the order except allowing him to take measure for having access to the site concerned for inspection as also for installation.  In the circumstances appeal is disposed with a direction to the Appellant to comply with the order impugned and for the said purpose to take police help, if so required, and in case such police help is sought the local police authority will make requisite assistance available to provide the Appellant access to the site concerned.
