This is an appeal filed by the opposite parties in CC.111/14 on the file of Consumer Disputes Redressal Forum, Wayanadu, Kalpetta challenging the order of the Forum dated, October 08, 2014 allowing the complaint and directing the opposite parties to refund Rs.5,00,000/- deposited with the opposite parties with interest and compensation of Rs.25,000/- and a cost of Rs.5000/-.
2. The case of the complainants as detailed in the complaint before the Forum in brief is this:-
Complainants are the husband and children of deceased Professor George. He deposited Rs.5,00,000/- with the opposite party’s Trust on June 21, 2011. On April 24, 2013 Professor George expired. When the complainants demanded the amount opposite parties refused. Therefore complainants filed the complaint for return of the said amount with interest, cost and compensation.
3. The opposite parties remained absent before the Forum. Therefore Forum accepted the evidence of the complainant and marked Exts.A1 to A9 and allowed the complaint directing the opposite parties to refund Rs.5,00,000/- deposited by Prof. George with interest and compensation of Rs.25,000/- and a cost of Rs.5000/-. Opposite parties have now come up in appeal challenging the said order of the Forum.
4. Heard the counsel for the appellant and respondents/complainants.
5. Taking into account the nature of the contentions raised by the parties we feel that an opportunity should be given to the opposite parties to contest the matter on merits. Therefore on June 11, 2015 we have ordered that appeal will be allowed on condition that the opposite parties deposits Rs.1,00,000/- before the Forum within one month.
6. Today when the appeal came up for hearing opposite parties produced receipt to show that they have deposited the amount before the Forum. Therefore appeal is allowed. The impugned order of the Forum allowing the complaint is set aside the matter is remanded to the Forum for fresh disposal in accordance with law. Both parties shall appear before the Forum on August 24, 2015. Rs.1,00,000/- deposited before the Forum shall be disbursed to the complainant.
