By Smt. Padmini Sudheesh, President: The complaint is filed to get back the amount deposited in the respondent company. The case is as follows. The complainant has deposited Rs.27,000/- as per statement No.28 on 12/8/2006 in the respondent company. The interest rate is 14%. The amount remitted has not refunded inspite of repeated requests. On 18/6/07 an amount of Rs.5000/- and Rs.800/- on 11/8/06 had refunded. The balance amount has not refunded till date. A lawyer notice was issued on 18.6.08. But there is no remedy. Hence the complaint. 2. The respondents called absent and declared exparte. 3. The complainant has filed affidavit and produced documents to prove his case. They are marked as Exts. P1 to P3. 4. According to the complainant, he has remitted Rs.27,000/- with the respondent. While receiving the amount it was promised that the deposited amount will be returned with 14% interest when demanded. But they given Rs.5000/- on 18.6.07 and Rs.800/- on 11.8.07. According to the complainant, he is entitled to get back the balance amount. 5. There is no evidence to the contrary. 6. In the result, the complaint is allowed and the respondent is directed to repay Rs.21,200/- (Rupees Twenty one thousand and two hundred only) to the complainant with interest at the rate of 12% per annum from the date of Exhibit P1 till realization with cost Rs.500/- (Rupees Five hundred only) within two months.
