The complaint is filed to get back the amount remitted in the kuri conducted by the respondents. The case of complainant is that the complainant had joined in the 5th day No.10 Monthly Chit conducted by the respondents vide statement No.691 to 693 started on 5th January 1998. The monthly subscription was Rs.1000/- and the complainant had remitted entire instalments. The kuri terminated on 5th March 2007. But the kuri amount has not been refunded. The complainant is entitled to get Rs.1,00,000/-. Even though a lawyer notice was issued on 30th September 2007, there was no reply or remedy. Hence this complaint.

            2. The respondents called absent and set exparte.

            3. The complainant has filed affidavit and produced documents to prove his case. They are marked as Exhibits P1 and P2.

            4. According to the complainant he had remitted the entire instalments and the amount had not returned. He is entitled to get Rs.1,00,000/- with 12% interest from 5/3/2007. But it is seen that there were 111 instalments and the complainant had remitted 110 instalments. So he is entitled for the amount remitted for 110 instalments with interest.

            5. There is no evidence to the contrary.

            6. In the result the complaint is allowed and the respondents are directed to pay Rs.1,10,000/- (Rupees One lakh and Ten thousand only) with 12% interest from 5/3/2007 till realization with cost Rs.1000/- (Rupees One thousand only) within two months.
