ORDER

By Smt. Padmini Sudheesh, President Petitioner’s case in brief is as follows: The petitioner had joined in a Pooval kuri under Class A- Statement No.40 on 4/7/00. Rs.4,000/- was the instalment amount. The Kuri had total 30 instalment out of which the petitioner remitted 22 instalments. Since the respondent Company is not functioned properly he did not remitted the Kuri from 23rd instalment onwards. It was realized that amounts are due to other subscribers. So the petitioner demanded his amount, not returned. Lawyer notice sent, no reply and returned as unclaimed. No remedy is availed. Hence this complaint. 2. The respondent set exparte on 30/1/08. 3. To prove the case of petitioner he has filed affidavit and 2 documents. The documents are marked as Exhibits P1 and P2. 4. Heard the counsel. 5. According to the petitioner he is entitled to get back the Kuri amount he had remitted i.e. Rs.88,000/- with interest. He also claims compensation and costs. There is no counter evidence. 6. So the petition is allowed and the respondent is directed to return the amount of Rs.88,000/- (Rupees Eighty eight thousand only) with 12% interest for each instalment from 4/7/2000 and 6% interest from today till realization. No order as to costs and compensation. Time for compliance one month. Dictated to the Confdl. Asst., transcribed by her, corrected by me and pronounced in the open forum this the 13th day of May 2008.
