ORDER

By Smt. Padmini Sudheesh, President: The case of the complainant is as follows: The respondent is a matrimonial agency. They have published an advertisement in newspaper on 28th January 2006 regarding a marriage proposal for which the complainant had applied for his daughter by V.P. He had sent Rs.600/- by V.P. and the commission amount was Rs.30/- only. It was accepted by the respondent and furnished ten marriage proposals, which were incomplete also. An agreement was executed concerning the commission amount. A full size photo was given to the respondent on demand. It costs Rs.180/- only. Even though ten proposals were furnished nobody had turned up. Hence this complaint. 2. Respondent declared exparte. 3. To prove the case the complainant has filed affidavit and five documents. The documents are marked as Exts. P1 to P5. 4. According to the complainant he is entitled for the expenses and compensation for mental harassment. He also claims for costs. He is a 81 years old man and coming from Pathanamthitta. Respondent is conducting the business in Thrissur. Fascinated by the advertisement in newspaper he came into contact with the respondent. 5. There is no contrary evidence. 6. In the result, complaint is allowed and the respondent is directed to pay Rs.5000/- (Rupees five thousand only) to the complainant for the mental agony he had suffered including costs also. Comply the order within two weeks. Dictated to the Confidential Assistant, transcribed by her, corrected by me and pronounced in the open Forum, this the 19th day of August 2008.
