Final Order / Judgement

Today is fixed for appearance.

The Ld. Advocate of the OP 3 and 4 namely Mr. Dineswar Ram Dubey is present. But neither the complainant nor the rest OPs entered appearance. It is reported by the Ld. Advocate of the OP 3 and 4 that he had informed by the Ld. Advocate of the complainant namely Mr. Samir Kumar Das and came to know from him that the complainant is not interested to proceed with this case.

It is also disclosed by the Ld. Advocate of OP 3 and 4 that the complainant and OP 3 and 4 resides in the same building.

Therefore we find reason to say that the complainant has received intimation about the transfer of this case from Barasat Commission to this Commission. But he is not interested to proceed with this case.

The complainant was directed on the previous date to show cause as to why the case would not be dismissed for default. Such being the position we find reason to record a dismissal order in this regard.

Hence it is ordered that the case be and same is dismissed for default.

Let a plain copy be given to the parties free of cost as per CPR.
