1. The present miscellaneous application has been filed by applicant/OP-Mahindra Holiday and Resorts India Ltd. for release of the amount deposited by them. 2. A perusal of the order dated 18.10.2021 passed by the Hon’ble National Consumer Disputes Redressal Commission in MA/95/2021 in Revision Petition No.3129 of 2013 indicates that an application (MA/95/2021) was filed by the Petitioner Mahindra Holidays & Resorts India Ltd. seeking release of the amount deposited before the District Consumer Disputes Redressal Forum-I, U.T. Chandigarh in compliance of the order dated 04.10.2013 passed by the National Commission. The Revision Petition was dismissed as withdrawn vide order dated 02.07.2020 and as per the settlement arrived at between the parties, the amount deposited by the Petitioner is to be refunded to the Petitioner. The Hon’ble National Consumer Disputes Redressal Commission allowed the application (MA/95/2021) and directed the Registrar of the District Forum to refund the entire amount deposited by the Petitioner along with accrued interest, if any. 3. Office was directed to make a report whether there is any stay order in this case or not and also to make a report about the deposit of the amount before this Commission for passing an appropriate order. As per office report, no stay order has been received and an amount of Rs.2,89,136/- has been deposited in this Commission and FDR has been prepared. 4. In view of the order of the Hon’ble National Consumer Disputes Redressal Commission dated 18.10.2021 passed in MA/95/2021 in RP/3129/2013, it is ordered that the amount of Rs.2,89,136/-, lying deposited with this Commission, alongwith accrued interest thereon be released in favour of applicant/OP-Mahindra Holidays & Resorts India Ltd. by way of cheque/draft, against proper receipt & identification. Office to take necessary action for release of the amount. The present miscellaneous application stands disposed off accordingly. 5. Certified copies of this order be sent to the parties free of cost. The file be consigned. |
