            1^st Respondent present. No representation for appellant. This appeal is posted today for the appearance of appellant and for filing written argument and for arguments or for dismissal. When the matter was called at 10.30 a.m the appellant did not appear, hence passed over and called again at 12.30 pm, then also there  is no representation for appellant. Though it is specially posted in the list today for arguments or for dismissal the appellant reminded absent. Hence keeping the appeal pending is of no use as appellant is not interested in prosecuting the case.

  Hence, the appeal is dismissed for default. No order as to cost.
