01. It is submitted by the Applicant that Consumer Complaint No.244/2021 & Consumer Complaint No.1180/2021 are pending for disposal on the file of the I Additional District Consumer Disputes Redressal Commission Bengaluru. Similarly, Complaint No.270/2021 & Consumer Complaint No.1011/2021 are pending for disposal on the file of the II Additional District Consumer Disputes Redressal Commission, Bengaluru. Further, he submits that in all the 4 cases, the Grievance & the Claims made by the complainant regarding closure of Senior Citizen Savings Scheme are one & the same and also common in nature. Hence, Transfer Application is filed seeking transfer of 2 Consumer Complaints to either of the District Commission, Bengaluru so that all the four matters are heard and decide by a single Commission.
02. In the above such situation and in considering the nature of the relief sought, the service of Notice to the Respondent is hereby dispensed with.
03. Heard the Learned Counsel for the Petitioner.
04. On perusal of the grounds mentioned in the Transfer Application, it is seen that the subject matter involved in all the 4 Complaints are common and the questions involved are also one and the same. In such circumstances to avoid conflict of decisions and also to make it convenient to both parties it would be just and proper to consider the request made in this behalf. Accordingly, Complaint No.270/2021 & Consumer Complaint No.1011/2021 pending on the file of II Additional District Consumer Disputes Redressal Commission, Bengaluru, is hereby directed to be transfer to the I Additional District Consumer Disputes Redressal Commission, Bengaluru, with a direction to the I Additional District Consumer Disputes Redressal Commission, Bengaluru to receive said complaints and dispose of all 4 matters in accordance with Law.
In view of aforesaid observation, TA No.10/2021 is disposed of.
The Office is directed to communicate the same to all concerned immediately.
