          This petition was disposed of on 20.3.2009 in the absence of the respondent as he had not appeared inspite of services.  Subsequently, the respondent/applicant filed a Review Application under Section 22 (A) of Consumer Protection Act, 1986 and keeping in view the facts and circumstances of the case, it was decided to

review our order dated 20.3.2009.  Notice was issued to both the parties for today’s hearing.

          Counsel for the respondent has been heard.  This case was decided as per law laid down by Hon’ble Supreme Court in “Postmaster, Dargamitta H.P.O. Nellore vs. Raja Prameelamma (Ms) (1998) 9 SCC 706.            

          However, in such cases, in order to give substantial justice to the parties, we have been directing the Ministry of Expenditure, Govt. of India to pay 6% interest to the depositor as the blame has to be shared by the postal authorities for issuing the Kisan Vikas Patras contrary to the rules.  In the present case the Saving Bank Interest has already been given by the State Commission.

          Counsel for the respondent informs us that the deposited amount along with Saving Bank Rate of Interest has already been refunded to the respondent.  We maintain our order dated 20.3.2009.
