Order

Heard on the application for condonation of delay. Contention of the applicant is that there is a delay of four days in filing of the appeal. Ld. Counsel for the appellant contended that certified copy of the orders was given to him late. Since the delay in filing the appeal is only of four days, the delay is condoned.

Appellant has impugned the orders dt. 27.01.2015, vide which he was proceeded against ex-parte. Contention of the appellant is that his Counsel Ms. Ravneet Kaur had put in her appearance and had sought a Passover. The same has not come on record.  It is also submitted by the Ld. Counsel for the appellant that the OP had put in his appearance in other matters listed in the said Forum on that very date. Be that as it may, we have no reasons to disbelieve the contention put forth by the Ld. Counsel for the appellant. Orders dt. 27.01.2015 passed by the Ld. District Forum, are set aside.

Ld. Counsel for the Appellant has state at bar that the matter is listed for final hearing for 19.05.2015. Let written version be filed by the appellant in the District Forum within a period of ten days from today with an advance copy to the opposite side.

Orders dasti. Copy of the orders be also sent to the District Forum concerned.

        File be sent to Records.
