ORDER

No one is present on behalf of the petitioner.  However, the respondent is present in person.

In view of ratio of the Apex Court’s decision dated 1st September 2009 in the case of “General Manager, Telecom versus M. Krishnan and Another [(2009) 8 Supreme Court Cases 481)]  this matter cannot constitute a “consumer dispute”.  The revision petition is, therefore, allowed and the complaint is dismissed as not being maintainable under the provisions of the Consumer Protection Act, 1986.

However, the respondent/complainant is given the liberty to avail of his remedy in accordance with section 7 - B of the Indian Telegraph Act, 1885.

Copy of the order be given dasti.
