                 ORDER

 

JUSTICE SHRI. K.R. UDAYABHANU:  PRESIDENT

 

The Revision Petitioners are the opposite parties/Insurance company in CC.211/11 in the file of CDRF, Alappuzha.  Revision petition is filed over the order declaring the opposite party/Revision Petitioner exparte.  It is the case that immediately thereafter the Revision Petitioner filed I.A.230/11 to set aside exparte order along with version on 11.10.11.  The same was dismissed on 27.10.11.  Final order has not been passed in the matter by the Forum.

 

2.      The respondent/complainant is filed an objection stating that the opposite parties were given sufficient time for filing version.

 

3.      In the circumstances the order of the Forum is set aside on condition that the Revision Petitioner/Opposite parties pay a sum of Rs.2000/- towards cost to the complainant.  On payment of cost the Forum will receive the version and permit the opposite parties to contest the matter and dispose of the case on merits.

 

Office will forward a copy of this order to the Forum urgently.
