Today, Sh. Sudhir Singh, Legal Manager, HDFC Life Insurance Company Limited, Lucknow along with learned counsel Sh. Prasoon Srivastava as well as learned counsel Sh. Sunil Rawat, have appeared on behalf of the appellants.
Respondent – Sh. Surendra Kumar Posti is also present in person along with his learned counsel Sh. Ashutosh Posti.
Both the parties have submitted a joint compromise (Paper No. 88), which is duly signed by both the parties, who have been identified by their learned counsel.
The said compromise is explained to both the parties along with their counsel, who after reading, understanding and perusing it, have endorsed their signatures on the compromise and accepted its terms and conditions.
As the terms and conditions of the compromise are accepted by both the parties along with their counsel, hence the said compromise (Paper No. 88) is hereby accepted.
Accordingly, the appeal is decided in terms of compromise (Paper No. 88), which shall form part of the order. Both the parties shall bear their own costs.
It is further directed that as per the terms of the above compromise, the appellants shall pay an amount of Rs. 8,36,916/- (Rupees Eight Lacs Thirty Six Thousand Nine Hundred Sixteen Only) to the respondent within two months’ from today and in default, the appellants shall pay simple interest @12% p.a. on the aforesaid amount w.e.f. today till actual realization.
The amount deposited by the appellants with this Commission as well as before the District Commission in compliance of order passed by this Commission, be released in their favour, after compliance of the terms and conditions of the compromise by the appellants.
