Heard learned counsel for the parties. 2. Learned counsel for the appellant submitted that counsel for the appellant inadvertently missed the hearing on 04-01-2014 and complaint was dismissed in default, which may be restored. 3. Learned counsel for the respondent has no objection in restoring the complaint subject to cost. 4. As complaint has been dismissed in default on account of non-appearance, we deem it appropriate to allow the appeal and restore complaint subject to cost. 5. Consequently, appeal filed by the appellant is allowed and impugned order dated 04-01-2014 passed by learned State Commission in Complaint No. 2013/04 - Green Garden Kalyan Samiti vs. Surendra Constructions is set aside and complaint is restored at its original number subject to payment of Rs.2,000/- as cost to the respondent. 5. Parties are directed to appear before State Commission on 07.06.2014.
