        Present appeal  has been filed for setting aside the order dated 19.07.2022 passed by the District Consumer Forum, Bhagalpur in complaint case no.69 of 2021 whereby and where under  the proceedings disposed of, as opposite party had redressed the grievances of the complainant. The electric bill  of January 2022 of Rs.1,16,715/-  was rectified  and payable amount was reduced to Rs.38,086/- and complainant expressed his satisfaction over this rectified bill and agreed  to pay said amount, accordingly complainant was directed to pay Rs.38,086/- and complaint case was disposed of. 

       Against said consent order present appeal has been filed on 30.05.2023 which was defective as appeal was barred by limitation, FDR was not deposited and a copy of written statement was not enclosed and accordingly 15 days time was granted by order dated 30.05.2023 to remove the defect and case was thereafter listed before the Registrar on 14.06.2023 but defects were not removed and the appeal was placed before the Bench on 28.06.2023, however no steps were taken to remove the defect as such 4 weeks further time was granted to remove the defects and accordingly appeal was listed on 16.08.2023.

        No one appears on behalf of the appellant today i.e.16.08.2023 and defects are also not removed by the appellant, as such appeal is dismissed for non prosecution. Even otherwise against a consent order appeal is not maintainable.
