ORDER

1.   Case called out intermittently. None appears for the petitioner.

2.   The perusal of record indicates that on 03.11.2023 none had appeared for the petitioner and the defects as pointed out by the Registry have not been cured. The proceedings dated 03.11.1023 may be quoted herein below

PROCEEDINGS

       None present for the Petitioner.

Registry has reported that the defects have not been cured in physical file and Revision Petition is not uploaded in the E-daakhil Portal.

The Petitioner who is regularly appearing through VC and who is not present today, shall cure the defects as detailed in the order dated 16.03.2023, within a period of four weeks, as a last and final opportunity.

In view of the intra office note dated 17.05.2022, list the matter before the appropriate Bench as per the present Roster for admission hearing on 29.12.2023, if the defects are cured and the complete E-daakhil (defect-free) file is uploaded or else for directions.

Let a copy of today’s proceedings be sent to the Petitioner through speed post, for information and necessary action.

3.   On the last date also, none appeared for the petitioner. The Order dated 29.12.2023 may be quoted herein below:

None appears for the petitioner.

The perusal of the order sheets shows that the defects have not been cured since long and repeated opportunities have been granted. However, in the interest of justice matter is deferred.

List on 06.02.2024.

In the meanwhile, defects as reported may be cured.

The Registry is requested to send a copy each of this Order to the petitioner within three days.

4.   Today again, nobody appears for the petitioner, neither the learned counsel nor the proxy counsel nor anybody else on his behalf. The office report shows that the defects as pointed out by the Registry have not been cured yet. 

      The instant petition stands dismissed in non-prosecution.

5.  However, in the interest of justice, it may be observed that if the petitioner wants to pursue the matter in right earnest with due diligence, he may move appropriate application seeking recall of the Order and restoration of the instant petition in accordance with law.

6.   The Registry is requested to send a copy each of this Order to the parties of the petition and to the fora below within three days from today. The stenographer is requested to upload this Order on the website of this Commission within three days from today.
