The record is taken up for passing order on the point of admissibility of the case.

The present case was filed on 24.08.15.

In view of Section 12 (3) Proviso further the admissibility of the Complaint shall ordinarily be decided within 21 days from the date on which the Complaint was received. But the President of this Forum was in Training at New Delhi and on leave.  So, the record is taken up for passing order.

Perused the Complaint and Xerox copy of the documents submitted by the Complainant

During hearing, the Complainant Sri Utpal Kr. Roy submitted that the Postal Department has been taking excess charges for Speed Post and Postal Order and, thereby, committed deficiency in service and un-fair trade practice.

In support of his contention, he submitted Xerox copy of some Postal Registration Slips regarding Speed Post of different amounts like Rs.30/-, 51/-, 135/- etc and counter foil of Postal Order amounting Rs.5/-, 10/- & 100/-.

But there are nothing to show that actually excess charges were taken by the Postal Department from him.

We further find that such type of complaint has been filed by the Complainant before Consumer Affairs & FBP Department, Cooch Behar and by sending Memo No.407/COB/CA & FBP dated 22.06.2015, the Assistant Director informed him that the redressal sought for does not fall under purview of Consumer Protection Act and dropped the case.

Considering over all matter into consideration, we do not find any prima facie case against the OP/Postal Department.

Hence,

          Ordered,

            That the CC/80/2015 be and the same is dropped for want of prima facie case. No cost.

Let plain copy of this Final Order be made available and be supplied free of cost, to the concerned party.
