B.Giri President (I/C)- The case in our hand filed by complainant nagendra kumar pahi alleging deficiency of service against Ops praying for 18% interest per annum from 29.4.16 to 12.2.17 with further direction to Ops to pay Rs 20,000/- towards compensation for mental agony and harassment and Rs 5000/-towards cost of litigation.
One case of the complainant in short is that complainant on 23.4.1991 opened one postal life insurance within sum assured of Rs 1,00,000/-for 25 years which was to be matured on 12.2.17 and after 5 days of maturity date i.e on 17.2.17 when complainant surrendered the original documents before Ops for maturity money Ops calculated the matured amount till 29.4.16 and the matured amount of RS 2,72,100/- has been duly paid to complainant and only after this complainant could able to know that the actual maturity date of this policy is 29.4.16 and not 12.2.17 which was mentioned in the policy bond and within this 25 years of deposit Ops never intimated the complainant the actual date of maturity and for such lapses the complainant could not utilize his total maturity amount for 29.4.16 to 12.2.17 and for these period the amount lies dead with Ops and hence this case.
After notice Ops time and again prayed for time to file written version but not filed the same and did not came forward to participate in the case as such ops are set exparte on 19.1.18
Heard the learned counsel for the complainant and perused all the correspondence of complainant filed in this case. From the Xerox copy of postal endowment assurance bearing policy No OR/22038-B issued by ops it is clear in the Colum of policy number and risk date is 12.2.17 and from letter issued by ops official on dt 21.2.17 vide L No OR22038-B addressed to complainant where it is clearly mentioned that maturity date is 29.4.16 and accordingly interest was calculated till 29.4.16 and within 25 years of deposit the Ops never intimated the actual date of maturity to the complainant and with impression that actual date of maturity is 12.2.17 complainant deposited the bond after 5 days I.e on 17.2.17 and the matured amount of Rs 2,72,100 laying dead with Ops from 29.4.16 to 12.2.17 and for such act of Ops can safely named as deficiency of service which caused financial loss to the complainant.
Under these circumstances we hold that Ops are deficient to render proper service to the complainant causing financial loss and Ops are liable for the same and complainant is deserve to entitle for his financial loss.
Accordingly it is ordered that both the Ops are directed to pay the interest @ 8% per annum on the maturity amount i.e 2,72,100/-from 30.4.16 to 12.2.17 and further to pay Rs 1000/-towards cost of litigation within 30 days of receipt of this order failing which the entire maturity amount will carry 12% interest per annum till payment.
The case is accordingly disposed of.
