19 | 09.11.22 | Today no step is taken by the Complainant. The record shows that on 03.11.22 no step was taken by the Complainant. On 03.11.22 the OP, Superintendent, Post Office, Murshidabad Division Berhampore filed a petition praying for dropping the instant case on the ground that the claim of the Complainant had been sanctioned and amount of Rs.7,58,515/- (Seven Lakhs Fifty Eight Thousand Five Hundred Fifteen) was disbursed on 02.03.21. The said petition is required to be heard today in present of both the sides but the Complainant is found absent on repeated calls. The case of the Complainant in short is that the Complainant Bishakha Ghosh Wife of Khokan Ghosh filed this instant case against the OPs namely, Superintendent of Post Office, Berhampore and Post Master, Farakka Post Office praying for reliefs to the effect - That an order may kindly be passed in favour of this Complainant and against the OP directing the OP to payRs.5,00,000/- plus interest + Rs. 50,000/-= Rs.5,50,000/- towards compensation for mental agony and harassment to this Complainant.
- That an order may kindly be passed in favour of this Complainant and against the OP directing to pay all costs of the case to this Complainant.
- That an order may kindly be passed in favour of this Complainant and against the OP which your Honour deems fit and proper and which may be available under law and equity.
Point to be noted is that Complainant takes no step today but the fact is that Ld. Advocate for the Complainant submits before this Commission that he tried to contact the Complainant but in vein. However, we peruse the materials on record and the letter of the Superintendent of Post Office, Murshidabad Division, Berhampore. Superintendent, Murshidabad Division, Berhampore intimating this District Commissions that the claim had been sanctioned and amount of Rs. 7,58,515/- was disbursed on 02.03.21. We find no reason to disbelieve the letter of the Superintendent of Post Office, Murshidabad Division, Berhampore particularly when there is no objection/dispute regarding the said letter. Such being the position, we are of the view that the instant case is required to be disposed of accordingly. Hence, it is ORDERED that the instant Complaint Case No. CC/63/2020 be and same is disposed of in view of the observations made in the body of the judgement. Let plain copy of this order be supplied free of cost, to each of the parties / Ld. Advocate/Agent on record, by hand /by post under proper acknowledgment as per rules, for information and necessary action.
