ORDER

1.        The present miscellaneous application has been filed on behalf of opposite party to release an amount of Rs.78,591/- deposited with this Forum vide MA No.93 of 2010. Notice of the application was sent to the complainant through registered post on 11.04.2017, but the same has not been received back served or unserved. Since a period of more than 30 days has elapsed, therefore, complainant is presumed to have been served. None has appeared on behalf of complainant.

2.        As per office report, an amount of Rs.78,591/- has already been deposited in this Forum. Office has also reported that no stay order has been received.

3.        Heard. In view of the facts stated in the application, the applicant/opposite party is entitled to get the amount deposited with accrued interest. Accordingly, the application is allowed. Office is directed to pay the amount of Rs.78,591/- stated above alongwith upto date interest in favour of applicant/Opposite Party against receipt on furnishing proper identification. The application stands disposed off. After release of the amount, this application be consigned to record room with the main file. Copy of this order be also placed on record the execution application file, if any.

4.        Certified copies of this order be sent to the parties free of cost.
